The H-1B is a non-immigrant visa in the United States under the Immigration and Nationality Act, section. This program is the primary method for employers to recruit & hire International professionals and International students to work in the USA from all over the world. The H1B visa enables US employers to hire foreign professionals for a specified period of time. The H1B program allows workers in specialty occupations to work in the US for up to a total of six (6) years.

The H1B is the most popular and sought after US work visa and US Immigration requires 'every' foreign national to obtain a visa in order to legally work in America.

 

Eligibility

The H1B visa is issued for a specialty occupation, requires theoretical and practical application of a body of specialized knowledge and requires the visa holder to have either:

  • The equivalent of a 4-year US equivalent Bachelor's degree, relevant to the field in which employment is being offered (Most UK Bachelor's Degree's are equivalent).
  • 12 years of relevant work experience in a "specialized field", or a combination of education and work experience totaling 12 years (1 year of higher education equals 3 years of work experience).
  • Professionals such as doctors, lawyers, and accountants must be licensed to practice in the state in which employment is offered. This may involve passing a relevant state professional examination.

One of the main advantages of the H1B visa is that it is a 'dual intent' visa which means that you can apply for a Green Card (Legal Permanent Residency).

    Step 1 - you Must 1st find an H1B Sponsorship Job with a US Sponsoring Company

  • Step 2 - your H1B employer files your H1B Visa Application with the US Immigration Bureau

Start step 1 - find an H1B Job and obtain visa Sponsorship –

An H1B visa is typically valid for up to six (6) years and entitles your spouse (husband/wife) and children (under 21) to accompany you and live in the USA on an H4 visa. The H4 dependent visa does not allow your spouse/children to work (unless they get their own H1B visa).

H1B Visa Qualifying occupation categories are typically jobs in the fields of IT, Computing, Finance, Accounting, Banking, Marketing, Advertising, PR, Sales, Recruiting, Engineering (all types), Teaching, HealthCare/Medical, Legal, Lawyers, Networking, Telecoms, Business, Management, Scientific Research.

 

Worker's family

The H1B worker's family may also be permitted to live in the US during the period that the H1B visa is in effect, but can not be a paid employee while on an H4 visa. An H1B holders Spouse and children (under the age of 21) can move to and live in the USA with the H1B holder - but they can not work unless they obtain their own work visa.
